Obama makes a recess appointment

Obama to recess appoint consumer bureau director

Why do we bother preaching a system of checks and balances all over the world when the reality is that we build in loopholes for seemingly every situation.  I understand the need to allow the President to have the authority to make appointments during recesses but that should only be used in times of emergency.  In this case, Obama was unable to appoint Richard Cordray when going through the proper legal channels.  Essentially, the proper channel said "no."  Rather than appoint another candidate to fill the void until a proper appointment could be made, he plugs in the same guy that the system he represents rejected.  Dirty pool.

  1. You're kidding, right? Don't you know that Cordray's qualifications have absolutely nothing to do with this? The Republicans were going to filibuster ANY candidate for this position since they don't want this new agency to exist at all. I think Obama did exactly what he needed to do to show that he won't let the Republicans deny regular Americans some protection from financial abuse at the hands of the banks and Wall Street. They want no regulation of any kind on the people and institutions that created the financial crisis in the first place.

  2. It's not about this specific individual, his qualifications, or the value of the department he's now heading up. That's a separate conversation. The point here is that Obama used the political process to circumvent the underlying principal of checks and balances. This was not an emergency appointment. It's also not that congress just didn't get a chance to vet the individual and make a decision. In this case, our elected officials looked at this candidate and by vote, said no. When they went home, Obama ignored them and put him in place anyway.

I'm not against the President having the power to appoint individuals in an emergency or when it is a requirement to get it done before Congress is in session. I have a problem with a President who ignores the process that's in place and uses an authority for a purpose that is was not intended for.
